Melrose Multimedia – Hosting & Domain Services Terms & Conditions

About Melrose Multimedia

Melrose Multimedia (“we”, “us”) operates online as a reseller of hosting and domain services via partner 20i. By ordering from us, you’re agreeing to these Terms & Conditions (including our GDPR Data Processing Agreement).

Your Status

When you set up an account and place an order with us, you confirm:

You’re at least 18 years old.
You have the legal right to enter into binding contracts (personally or on behalf of a business).

Ordering Process

You must register an account and provide accurate information.
You remain responsible for keeping your login credentials secure.
Before completing an order, you’ll see a summary of services and pricing.
We accept payment via credit/debit card or approved direct debit.
We’ll email you a confirmation and invoice for each order.

Contract Formation

Your order is an offer. We accept it when we confirm it by email (“Acceptance Confirmation”).
We may decline orders without obligation.
Our contractual responsibility applies only to the services confirmed in that email.

Services Provided

We link to third-party products or services for convenience. We don’t guarantee them or take responsibility for them.
Your consumer rights are your own and unaffected by this disclaimer.

Consumer Cancellation Rights

As a consumer, you normally have 14 days to withdraw from a contract, but this right ends if service starts before then.
By ordering, you agree to immediate service activation and waive your cancellation right.

30-Day Money-Back Guarantee

Within 30 days of service activation, you may request a full refund on hosting services (one per customer).
To cancel, submit a support ticket and confirm cancellation via reply email.
Domain registrations, SSL certificates, VPS packages, and other add-ons are exempt from this guarantee.

Pricing & Payment

All service costs are clearly displayed before purchase (VAT excluded).
Prices may change with 14 days’ notice. Continued usage equals acceptance.
In case of pricing errors, we reserve the right to correct or cancel your order.
Late payments may result in account suspension or recovery actions.

Our Commitment to Quality

Hosting services are delivered with reasonable care and skill.
Claims must be reported promptly; refunds or fixes are at our discretion.
You must follow any instructions we provide for service usage.

Hosting Service Access

You must maintain access credentials and ensure your users comply with these Terms.

Service Availability

We aim for continuous service but cannot guarantee it.

IP Address Allocation

IP addresses provided are temporary and non-transferable.
We’ll do our best to minimize disruption if addresses change.

Backups & Your Data

Our Timeline Backups system creates daily website and database snapshots on a secure, separate server.
While you can create manual backups via the control panel, maintaining your own backups is your own responsibility.
We retain server archives but won’t give direct access to them.

Usage Limits

Monthly bandwidth limits apply per package and are enforced automatically.
CPU usage is limited to 10% per hosting plan (unless VPS).
Unused mailboxes are deleted after 100 days of inactivity.
Violation of acceptable-use policies may lead to suspension.

Support

We support service-related issues via online ticket or chat.
We don’t provide custom programming support.
Phone support is not available.

Domain Services

We’ll register or renew domains on your behalf, subject to registry rules.
You must comply with all relevant domain rules and regulations.
We will renew domains automatically unless you cancel the service.

Intellectual Property

You retain ownership of your content and grant us hosting rights.
You’re responsible for ensuring your content doesn’t infringe on third-party rights.
We license software for hosting but retain ownership of our infrastructure.

Limitation of Liability

We’re not liable for any indirect or consequential losses (e.g., lost profits, revenue, or data).
Our maximum liability is limited to the total fees paid in the preceding 12 months.
We cannot exclude liability for death or personal injury from our negligence, or for fraud.

Termination & Cancellation

Domain registration ends upon cancellation or if we terminate due to breach or inability to register the name.
Other services may be cancelled monthly with 30 days’ notice or by you via support ticket.
Partial-month refunds are not available.

Data Deletion

Upon cancellation, all service data is deleted. Back up your data beforehand.

Amendments

We may add service-specific terms; you’ll be informed in advance.

Electronic Communications

Notices and contracts are delivered electronically (via email or account dashboard).

Notices

You must send any official notices by means outlined in our support system.

Contract Transfer

This contract binds both parties and their assigns; you cannot transfer it without our written approval.

Force Majeure

We’re not liable for failure caused by events beyond our control (e.g., natural disasters, network outages).

General Provisions

Waiver or invalidity of any term doesn’t nullify the rest.
These Terms, plus referenced documents, form the entire agreement.
You acknowledge you haven’t made any representations outside these terms.

Acceptable Use Policy (AUP)

Melrose Multimedia prohibits any use of its services involving unauthorized access attempts, hacking, phishing, harassment, spreading false information, interference with services, or any disruptive activity. Violation of this policy may result in immediate suspension or termination of services without refund. Repeat or severe offenses may lead to permanent account termination and potential legal action.

Security Incident Response Policy

Melrose Multimedia monitors for and responds to security incidents such as unauthorized access or attempts to sabotage services. Customers or associated parties found intentionally jeopardizing security will face immediate suspension or termination of service. In such cases, Melrose Multimedia reserves the right to pursue legal remedies to protect its infrastructure and users.

Communication Policy

Only authorized representatives of the customer organization may communicate with Melrose Multimedia about accounts or services. Attempts by unverified or unauthorized individuals to intervene or disrupt communications will be ignored, and if persistent, may cause suspension or termination of service.

Dispute Resolution Policy

Melrose Multimedia encourages disputes to be resolved through official, direct channels. Unauthorized interference with domain control or service operation is strictly prohibited and may result in immediate suspension or termination. If necessary, disputes related to domain ownership will be handled according to ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP).

Termination for Cause

Melrose Multimedia reserves the right to suspend or terminate services immediately if a customer or any associated party engages in malicious behavior, repeated unauthorized access attempts, interference with services, or breaches these policies. No refunds will be provided for termination due to cause, and legal actions may be pursued as necessary.

Confidentiality and Non-Disparagement

Customers agree not to spread false, misleading, or damaging statements about Melrose Multimedia or its services. Violations may lead to service termination and potential legal action to protect Melrose Multimedia’s reputation.

Changes to Terms

Melrose Multimedia reserves the right to revise, update, or modify these Terms and Conditions at any time, effective immediately upon posting to our website. We may make changes with or without prior notice to users. Continued use of our services after any changes constitutes acceptance of the new terms. Updates required by law may apply retroactively as needed. Any modifications to these terms will be effective only if posted in writing by Melrose Multimedia; no oral statements or unsigned versions shall have any effect.
